This report analyses the rules genesis, application and impact on families and children, providing a statistical analysis on the numbers applying and succeeding whilst also looking at Home Office decision making.  This is the first report, procuded by JCWI in collaboration with BritCits, which looks at the ADR rules in detail.

Postman's Park

This sunny afternoon occasioned a summit of BritCits trustees in the vicinity of Postman's Park in the City of London.

A bit of an oasis amid the hubbub, Postman's Park hosts the delightfully-named Memorial to Heroic Self-Sacrifice, which commemorates ordinary folk who gave their lives to save others (e.g. William Drake 'lost his life in averting a Serious Accident to a Lady in Hyde Park'; Henry James Bristow, aged eight, 'saved his little sister's life by tearing off her flaming clothes but caught fire himself and died of burns and shock'). All using charming Victorian typeface and diction. It occurred to me that both saved and saviours have now passed from this earth, yet their deeds are immortalised in this tranquil place.

We came across this gem :

'In 2013, three (unrelated) families took the Home Office to court over the impact of the financial requirements within the Rules. The hearing in High Court was in February 2013 with the judgment coming out on 5 July 2013. The hearing was on the impact of the rules on citizens, residents and refugees - with the judge seeming to be especially concerned about the impact of the rules on citizens and refugees - one group that have the right to live here without let or hindrance and another, as refugees, we have a responsibility towards. The judge suggested that individually each of the requirements may be okay but put together with the first £16k of savings ignored, £18,600 so much higher than minimum wage, third party support not allowed, credible job offers for non-EEA partner disregarded, was too onerous.

'That this House condemns the Financial (Minimum Income) Threshold in the Immigration Rules introduced by the Government which came into force on 9 July 2012; notes that the rules are having a negative impact on UK citizens who have spouses from non-EU/EEA nations and is resulting in families being forced to live outside the UK or to live separately in different countries; calls on the Government urgently to lower the threshold for the minimum income and allow families to return to the UK with immediate effect; further calls on the Government to implement the recommendation of the All Party Parliamentary Group (APPG) on Migration to undertake an independent review of the Financial (Minimum Income) Threshold generally to ensure that families with spouses from non-EU/EEA nations with stable and reasonable incomes are granted permission to immigrate to the UK; and notes that the UK's four children's commissioners all endorsed the APPG report on Migration and its recommendations.'

Married but alone: The student couple separated by immigration laws

'Imagine being recently married, but forced to live separately from your partner. For many married students, this is a reality.

'In July 2012, the government increased the salary requirement for a British person bringing a non-EU spouse into the UK to £18,600. If the couple have children, the amount rises to £22,400, with an extra £2,400 for every child thereafter.

'The income requirement does not take the non-EU partner's income into consideration, only that of the British partner. Nor are regional differences in pay considered, so someone in London is much more likely to be able to meet the requirement than someone from other parts of the UK where the average salary is lower.

'Around 47% of the working population would not be able to meet the requirement, according to the charity BritCits, a human rights organisation campaigning on behalf of families with immigration problems.... '

Press Association: Guidance on legal aid 'unlawful'

'Guidance issued by Lord Chancellor Chris Grayling in relation to granting legal aid for immigration cases has been ruled "unlawful and too restrictive" by the High Court.

'Quashing refusals of legal aid in six cases, a judge said the guidance "sets too high a threshold" and "produces unfairness" by denying publicly-funded legal advice to applicants in "exceptional cases".

'Mr Justice Collins, sitting in London, said it was "a fundamental principle that anyone in the UK is subject to its laws and is entitled to their protection".

'He said: "Thus there must be a fair and effective hearing available and the guidance, as the facts of some of the cases I have dealt with show, produces unfairness".

'The mother of a British boy who had been trapped in Syria for three years has spoken exclusively to the BBC after he finally reached safety by crossing the border into Jordan.

'For half his life, six year old Muadh Zein, has been trapped in war. When he was three-and-a-half his Syrian mother took him to see her family near Deraa, the opposition stronghold where the Syrian uprising began in 2011.

'Less than a week ago, he and his mother crossed into Jordan and safety. But it's a stop his family hope will be temporary, as the Birmingham-born boy and his mother try to get back to the UK.

'Muadh sits quietly now, on the cushions on the floor of his uncle's house in Jordan. They are still close enough to the border with Syria to hear the shelling. Muadh sits impassively as another boom is heard in the distance... '

So far, William Hague has stayed silent, but if enough of us pressure him, we could get him to act.

'Muadh was with his favourite uncle when a barrel bomb exploded close to them. He survived, but witnessed the death of his uncle. In another attack, Muadh again survived but witnessed a relative sustain a severe head injury.

'After suffering through a period of intense bombing, my son has now developed a permanent convergent squint to his right eye, an eye condition that requires immediate medical attention. I have shown a photo of him to his GP in Birmingham, who has advised me that Muadh must undergo an immediate operation.

'My son has seen more horror in his six years than most adults see in a lifetime. Muadh has become traumatised as a result of the first-hand violence he has witnessed. He has stopped speaking, and is suffering physically and emotionally on a day-to-day basis. '

MRN: '... A few weeks ago, we were contacted by a lady called Margaret, who lives in South Wales. Margaret has worked for the past decade as a legal secretary for a private solicitors firm, earning £13,500 a year. However, her salary is not considered adequate in order to sponsor her Tunisian husband to enter the UK, and so they are living apart for the foreseeable future...

'...  Margaret is not the only person whose earnings are too low to meet the rules and be with her husband. 47% of the working population are reportedly unable to sponsor a loved one, on the basis of their earnings. Because £18,600 is considerably higher than the national minimum wage (approximately £13,200 per annum at a full time rate), some people, like Margaret, are in full-time employment and still fail to meet the rules.

'But, crucially, where you live and work in the UK is a significant determiner of your ability to live with a foreign partner. New research by MRN, released today, shows that being able to live with your non-EU spouse is now essentially subject to a postcode lottery.'

As we grow the campaign, it's vital that we get feedback from those affected by the UK's family immigration rules, their families, their friends, and from people who support the campaign because they believe in human rights.
