Plight of Syria Britons highlighted
The Government is "actively leaving" relatives of British nationals in danger in Syria by dragging its heels with their visa applications, campaigners have claimed.
http://www.express.co.uk/news/uk/439448/Plight-of-Syria-Britons-highlighted
'Frustrated relatives have started a petition to urge officials to prioritise visa applications by their spouses and family members who are currently trapped in the war-torn country, calling for officials to recognise the "exceptional circumstances" they are facing.
'The petition, on campaign website Avaaz, calls for the Government to prioritise applications from people in Syria, so they can join their spouses and relatives in the UK...
'... Christine Gilmore said her husband Ziad is stuck in Damascus in "absolutely dire" circumstances, and accused officials of actively leaving him in danger.
'Ms Gilmore, 33, met her 50-year-old husband in Damascus, where she spent a year as past of a masters degree in Arabic.
'After meeting in May 2010 the couple decide to marry, and underwent a marriage ceremony in Syria in October 2011, she said.
'But she claimed their attempts to get him a visa so he could join her in the UK and escape the dangers of Syria have failed, despite meeting income and English language requirements...'
'... Shafik Salih, 42, of east London, said he was suffering in the same situation, with an application for his Syrian fiancee Nesrin, 33, refused.
'The couple, who met on when Mr Salih was visiting Damascus in 2008, got engaged in December 2012 but a visa application for Nesrin was refused earlier this year and they are currently awaiting an appeal due to be heard in April 2014.
'Mr Salih said: "I talk to my fiancee every day on Skype, chat and phone. The electricity is available for short periods, the Internet connection is very bad.
'"My fiancee is ill and she needs medications. The security position is very dangerous up there and I am worried about her.
'"My fiancee is in a war zone in Syria. She is in real danger and needs urgent health care."

UK Government save the family members of British citizens trapped in Syria!
https://secure.avaaz.org/en/petition/UK_Government_Save_the_Family_Members_of_British_Citizens_Trapped_in_Syria/
Why this is important
Syria has been described as the most dangerous country in the world. Yet the UK Border Agency and Home Office continue to deny visas to the Syrian family members of British citizens trapped inside a war-zone where they are in constant danger of death.
At the G20 meeting this year David Cameron spoke of the 'moral imperative' to tackle the humanitarian crisis in Syria. But due to recent changes to the UK's Family Migration Rules, many British citizens are no longer able to sponsor close family members in Syria to come to the UK to escape the violence, separating babies from parents, wives from husbands, and elderly people from family members in the UK who could support them.
The family members of British citizens trapped in Syria are in imminent danger of death! Yet something can be done: the new visa rules that came into force in July 2012 allow for "exceptional and compassionate circumstances" to be taken into account in cases where it would be impossible for family life to continue in the partner's home country.
We call on the UK government to grant visas to all close family members of UK citizens fleeing the violence in Syria. Please sign today to show your support.
*The new Family Migration Rules that came into force in July 2012 state that couples fleeing the war zone in Syria must earn £18600 per year or have £62500 in the bank, as well as passing an English Language Test and presenting documents almost impossible to obtain in a war zone. Such high financial requirements have been described by a High Court Judge as "disproportionate" since they prevent 47% of the working population of Britain from sponsoring a non-EU family member. The Home Office is currently appealing this decision.

Salmond's visa plea as family tries to be reunited.
http://www.heraldscotland.com/mobile/news/home-news/salmonds-visa-plea-as-family-tries-to-be-reunited.22174648
'ALEX Salmond has called on the Home Office to speed up visa applications as a Scotswoman battles to bring her Syrian husband to the UK.
'The family of Christine Gilmore, 33, from Edinburgh, contacted the Scottish Government over her fears that Ziad Arabi-Katbi will be killed before the decision is made.
'She met her husband while studying in Damascus but the couple have been separated by the turmoil which has engulfed Syria.
'The First Minister has written to Foreign Secretary William Hague to personally intervene and help the family be reunited. He said: "The plight of British citizens and their families caught up in the crisis has been brought to my attention. Professor Bill Gilmore and his wife Dr Patricia Gilmore have written to me about the case of their daughter Christine and her husband Ziad Arabi-Katbi.'

Professor decries lack of help for son-in-law stuck in Syria.
http://www.heraldscotland.com/news/home-news/professor-decries-lack-of-help-for-son-in-law-stuck-in-syria.22109131
'THE father of a Scotswoman whose husband is trapped in Syria has criticised the Home Office for not doing enough to help those who have spouses trapped in war zones.
'Professor William Gilmore's daughter Christine is married to Ziad Arabi-Katbi and awaiting a Home Office decision on his visa to come to the UK.
'He is currently stranded in Damascus while the British Embassy in Amman holds his passport as they review his application.
'Yesterday Foreign Secretary William Hague held talks with American Secretary of State John Kerry, who described the use of chemical weapons in Syria as a "humanitarian catastrophe of global proportions".
'However Professor Gilmore has spoken out about the "lack of joined up thinking" by the UK Government, particularly the Home Office's "business-as-usual response".

Missed deadlines, lost wedding certificates, and baffling incompetence: Welcome to the Home Office.

'We got married at the tail-end of 2012, and were then planning to return to the UK. By now, that little idea I came up with was running gangbusters, and my bonnie lass was ready for a change of career — no longer wanting to work in special effects, she was showing her Silicon Valley roots by seeking work at a tech start-up.
'But first, we have to get a Magical Piece of Paper from the Home Office, confirming that she is not one of them illegals. Of course, that would be easy, right? I am an EU citizen, she is married to an EU citizen; I have a job, we have a lovely flat, and we are married — happy, and rosy as can be, right?

Excerpts :
Andrew Percy (Con, Brigg and Goole):
Shantar’s visa application has been rejected on a number of grounds. Two of them were
technical issues to do with some lost paperwork. The embassy in Cambodia apparently lost her English language certificate, which I have managed to get a copy of, and it is hoped that that problem will be solved. Another issue regards accommodation in the UK, which has been, or is being, resolved.
... Denying some of those people access to join their family is having a detrimental effect on the UK economy. When they come here their passports are stamped with the words “No recourse to public funds”, but they are often people who, if they were here working, as in the case of my constituent, whose wife has a job offer, would be paying tax and contributing to the UK economy.
No recourse to public funds image : http://britcits.blogspot.co.uk/2013/07/jay-alberto-we-just-want-to-live-our.html
Neil Parish (Con, Tiverton and Honiton) :
I have a constituent called Mrs Celia Elizabeth Parr who is married to a doctor from Ecuador, and they have a little child. Mrs Parr lives in Colyton, and she has enough self-employed income, but she has experienced huge problems getting her husband into the country. We very much support tighter immigration controls, but we seem to be stopping people who have a legitimate right to be here from putting their family back together again.

Fiona Mactaggart (Lab, Slough) :
One of the things that has distressed me about the many cases that I face in Slough is having to say to one or two of my constituents who are dual nationals from another EU country that it would be in their interests not to use their British citizenship, but to go and work in the country of another EU citizenship — say, Irish — and then bring their spouse here.

For newbies : http://britcits.blogspot.co.uk/2013/08/surinder-singh-for-newbies-httpwww.html
Kerry McCarthy (Lab, Bristol East) :
I have a constituent who wants to be in Bristol to look after his sick parents. He has a Thai wife. They have moved to Spain so that they can take advantage of the laws there and eventually come to the UK. That is ludicrous. He has had to go and live in Spain with his wife and child although they have no connection with that country at all, as that is the only way round the rules.

Partners and families of British citizens in Syria
Readers will be familiar with the stories of Christine and Shafik. Christine's husband Ziad, and Shafik's fiancee Nusrin, are both in Syria - family migration rules are keeping them apart from their partners, and putting the lives of the partners of British citizens at risk.
BritCits supporter @salcardiff has prepared the following template letter for MPs, requesting urgent action on behalf of those affected.
Please consider writing to your MP. You can find your MP's contact details using this tool :

Dear <salutation>,
I am a supporter of the BritCits group, formed in direct response to the attack on British citizens and residents with non-EEA family members.
Recently, BritCits has heard from a number of British citizens whose partner is stranded in Syria. We are aware that the effects of the family migration rules can be very heartbreaking and distressing for families separated by them, however these cases are particularly urgent as the very life of the partner of British citizens is in danger.
I am sure that this is just the tip of the iceberg and there are many families affected in this way given that there have been indications that in the last three years only two settlement visas have been issued to Syrians applying from Syria and more recently, Lebanon since the British embassy in Damascus was shut down.
Having a spouse in the UK means that the Syrian national in question has a home to go to with ties to the UK. I hope you will agree that it is imperative that such families especially be reunited and removed from what is universally agreed to be a dangerous and potentially fatal situation.
I am particularly concerned that where a couple has recently made an application and fail to meet the rules only due to the financial requirement, such an application will now be on hold while the Home Office considers whether it will appeal the recent decision of the MM & Ors vs. SSHD case by Justice Blake. For most couples affected in this way, this will be a particularly frustration time due to delays and uncertainty, but for those couples where one partner is caught up in the situation in Syria, the frustration becomes a matter of life and death.
There may also be cases where families originally from Syria but settled in the UK may have elderly dependent relatives in Syria. Such families will have no hope of bringing their parents here as the route for elderly dependents is now effectively closed and has been dubbed 'a ban masquerading as a rule'.
I plead with you to as a matter of urgency, assist Syrians with family ties to the UK to be brought out of danger and reunited with their loved ones.
Given that the UK could even consider military intervention, it would not be appropriate for the government to deny such a proposal with the dubious excuse of protecting the public purse.
Even in this day and age, there is and must remain, space for basic decency, humanity and respect not just for family life, but human life.
Yours sincerely,

'Trapped in Syria's civil war with no escape'

'A British woman whose Syrian husband is desperate to join her in the UK says new family migration rules are keeping them apart and putting his life at risk.
'On a park bench in Leeds, Christine Gilmore is on the verge of tears. She's near the end of her story about her attempts to rescue her husband from the ravages of the Syrian civil war.
'She wants to bring him to the UK, but under the new family migration rules, the hurdles - even for her, a highly educated PhD student - are daunting.

"The Government won't let my husband into UK - while they talk about bombing the bejeezus out of his neighbourhood!"
http://carons-musings.blogspot.co.uk/2013/08/the-government-wont-let-my-husband-into.html
Does the UK Government not have a duty of care to the Syrian spouses of UK citizens? Given the imminent military intervention should they not help get them out the country or at the very least speed up their visa decisions? Given Cameron's determination to 'protect civilians in Syria' why can he not start by protecting Syrians with proven ties to the UK? I am not asking for special measures to circumvent the rules (in any case I meet the visa requirements) but simply for my government to stop dragging its feet in determining his visa case in this emergency situation. If my British citizenship, and indeed British values, means anything I beg my government to do something to help my husband get out of there.
A great piece on Christine, whose husband is trapped in Syria right now - trapped because of a technicality in the spouse immigration rules.
You see, Christine -meets- the economic requirement with a combination of income and savings - but immigration officials have denied the request because they 'objected to my stamped and printed online bank statement which evidenced my substantial savings of in addition to my tax free income'. A mere technicality - especially given that the statements were -stamped-.

Christine
Given the emergency in Syria and the urgency of this story, this needs to be spread far and wide. Christine has done the right thing in contacting her MP, who has committed to fighting her corner, and her local media. This story needs all the attention it can get - urgently.
'My name is Christine.
'My husband is stuck in Syria and the UKBA has rejected our settlement application once (they said that I had provided insufficient evidence to prove I met the financial requirement and that he had met the English language requirement. They objected to my stamped and printed online bank statement which evidenced my substantial savings of in addition to my tax free income. (Note - income is under the requirement but income plus savings put Christine above the economic requirement to sponsor spouses). They further claimed that without the certificate of entry into the KET the certificate we provided was invalid. Needless to say, they were splitting hairs). I reapplied on 15 July with all the additional information present.
'Now the problem of course is that there has been a serious escalation in the war in Syria particularly in and around Damascus. Ziad my husband lives only 15 mins away from the chemical weapon attack sites. One day later there was a huge car bomb near our house. Just yesterday his car was sprayed with bullets and he was detained. I still don't know why. He says he is under threat from the regime who may not now allow him to leave the country.
'The point I want to raise in advance of Parliament convening to discuss the Syria issue is this. Does the UK Government not have a duty of care to the Syrian spouses of UK citizens with proven links to the UK to prioritise their visa decisions? Does the fact that the Home Office/UKBA are leaving such people high and dry not contravene the FCO (and indeed Cameron's) policy and rhetoric on Syria and the humanitarian cost of the conflict. I want to sell this as a Syria policy issue not an immigration issue. I am not asking for special measures to circumvent the rules (in any case I meet the financial requirements) but simply to raise my case because of the humanitarian situation.'
