The trials of Roseline Akhalu - updated.

Yesterday judges in the Upper Immigration and Asylum Tribunal rejected an appeal from the Home Secretary, Theresa May, that Roseline Akhalu, a 49-year old former postgraduate student from Leeds should be returned to Nigeria where she would have faced the prospect of death ‘within weeks’.  On hearing news of the judgment Roseline Akhalu told her friends and supporters: “Thank you everybody for the support, for the prayers, for the publicity, for everything. Hopefully the UKBA will let matters rest at this stage.”

In London today judges rejected an appeal by Home Secretary Theresa May to deport a kidney-transplant patient to certain death in Nigeria. May had sought to overturn decisions by two judges permitting Roseline Akhalu stay in the UK.

'Why is the Home Office continuing this cruel and ludicrous campaign? It seems the department is concerned about growing case law that would facilitate health tourism. Under the present laws it is acceptable to deport someone even if they’ll become terminally ill on arrival in a new country, and this is why Rose’s case has been argued under Article 8 of the European Convention of Human Rights: a right to a private and family life.  But this is an exceptional case: is the fight against case law really worth a human being’s life, not to mention the massive legal cost? And as representatives from the National Kidney Foundation have said, donors would think their efforts were a waste of time if a recipient was allowed to die.'

Roseline arrived in the UK in September 2004 from Nigeria on a student visa, to study for a Masters Degree at Leeds University.

She unexpectedly developed end stage renal failure in 2005 and remained on dialysis until she was fortunate enough to receive a kidney transplant at St. James Hospital, Leeds in July 2009.

Roseline has applied for leave to remain in the UK but has been refused. Roseline’s consultant has stated that unless Roseline is able to continue taking immunosuppressant drugs which are costly and unavailable in parts of Nigeria, her transplanted kidney will fail and she would have to resort to dialysis again –a treatment she could not afford. Without this she will die.

Roseline has never been allowed to work and has been supported since 2007 by parishioners from St Augustine’s RC Church, Harehills and the St Vincent de Paul Society. Roseline is loved and respected by her fellow parishioners and many people in the wider community who have formed close friendships with her. In spite of her health problems, Roseline has volunteered tirelessly in the parish and is actively involved in a number of community based groups.

Quintessentially English | The visa application saga.

For those of you who read my post Another Two Years, you know that on 4 April I sent off my application for an extension of stay in the UK. Then on the second of May I went down to the Post Office to give my biometric data (fingerprints and photo). On 9 May, I was delighted to find a thick parcel from the UK Border Agency sitting in my post box. Could this actually be my passport and biometric residence permit back?! 

Well I did receive my passport back but for all the wrong reasons. Unfortunately my application had been deemed invalid because I, like a complete and utter moron, didn't tick a box saying that I hadn't committed any war crimes. This meant that my application was incomplete and could not be approved. Not only that, but the application forms and fees had changed on 6 April meaning I needed a completely new application and to pay an additional higher fee than the one I had already paid.

Friends and supporters of a severely ill Leeds widow who faces being ‘deported to die’ are making a last-ditch appeal to the Home Office to abandon what they have termed its “relentless persecution” of her.

As reported previously in the YEP, Nigerian-born kidney-transplant patient Roseline Akhalu has been fighting a five-year battle to remain in the UK.

The 49-year old’s initial joy at an immigration tribunal’s decision to uphold her recent appeal turned to despair when it emerged the Home Secretary intended to challenge the judge’s decision.

Now her lawyers have learned that the Home Office has indeed won official permission to appeal against the ruling of the immigration judge last November.

In Parliament last week Greg Mulholland, the Liberal Democrat MP for Leeds North, challenged the Home Secretary over her relentless persecution of Roseline Akhalu, the kidney-transplant patient who, nobody disputes, will die horribly if she is returned to Nigeria. The latest news is bleak indeed. On 6 February Roseline’s lawyers learned that the Home Office had won permission to appeal against the ruling of an immigration judge late last year allowing Roseline Akhalu leave to remain in the UK.

This Home Office research report provides evidence on the behaviour of migrants entering the UK immigration system for the five main routes of entry to the UK and the common pathways through the Immigration System that result in settlement.

This third report follows on from ‘The Migrant Journey’ (Achato, Eaton and Jones, 2010) and ‘The Migrant Journey: Second Report’ (Achato, Eaton and Jones, 2011), by providing new analysis on two further cohorts of migrants granted entry clearance visas in 2005 and 2006 and migrants granted settlement in 2010 and 2011.

The report also provides updated estimates for the previously published 2004 and 2009 cohorts. For the first time migrants granted visit visas have been included.

Good piece by Dr. Scott Blinder of the Migration Observatory ( http://migrationobservatory.ox.ac.uk ). The Migration Observatory is one of our favourite resources for geographical research.

... is a key piece of evidence on the issues around the campaign by the Migration Obsevatory. This paper suggests around half of all Brits will now be unable to bring their non-EEA partner into the UK.

It should be admitted, though, that this research by Migration Observatory is around the 'blunt instrument' of the £18,600 income level ( more on this on our introduction page : http://britcits.blogspot.co.uk/2013/01/introduction.html ).

At least one of our sources in academia suggests that, with additional restrictions, the proportion of Brits unable to bring their families into the UK may be far higher. Restrictions such as:
- lengthening the time to indefinite leave to remain from 2 to 5 years (and given that employers are likely to be hit with a big fine if any employees are found to overstay, it is unlikely that many will want this overhead; it is also likely that with the additional uncertainty this brings, many couples will feel unable to make their homes in the UK).
- increasing the language requirement from A1 to B1 level (for comparison, A1 is 'entry level' English; B1 is the same level that is needed to study at HND level - the British equivalent of an associate's degree - this is a huge jump and far in excess of the language level needed to integrate into British society).
- the additional income requirements for children (an income of £22,400 for the first child, with an additional £2400 for each child after that).


We are already hearing many reports of the additional stress put on relationships and families, of fathers who have in fact never held their children; it is inevitable that families will be broken up by these inhumane rules. The rules have only been in place for a few months, but are taking a great human toll.

Late last year, in two successive rulings, judges found that the Home Office was wrong to try to deport the kidney-transplant patent to certain death in Nigeria. But on 4 January Akhalu learned that the Home Office would fight on to remove her from Britain...'

The trials of Roseline Akhalu

'Why is the Home Office continuing this cruel and ludicrous campaign? It seems the department is concerned about growing case law that would facilitate health tourism. Under the present laws it is acceptable to deport someone even if they’ll become terminally ill on arrival in a new country, and this is why Rose’s case has been argued under Article 8 of the European Convention of Human Rights: a right to a private and family life.  But this is an exceptional case: is the fight against case law really worth a human being’s life, not to mention the massive legal cost? And as representatives from the National Kidney Foundation have said, donors would think their efforts were a waste of time if a recipient was allowed to die.'

A great piece on an appalling case - the Home Office seems determined to send a human being to her death, stalking her through the courts.

The findings were published in the Independent Chief Inspector’s report on the handling of legacy asylum and migration cases. The Chief Inspector also raised concerns that his findings did not correlate with the information that was provided by the Agency to Parliament.'

'The flawed implementation of a policy change in July 2011, coupled with poor customer service, adversely affected a number of applicants. It led to lengthy and distressing delays for affected asylum applicants, including former unaccompanied asylum seeking children, whose cases should have been dealt with in a timely fashion.'

'Such was the inefficiency of this operation that at one point over 150 boxes of post, including correspondence from applicants, MPs and their legal representatives lay unopened in a room in Liverpool.'
